A power of attorney lets you choose someone to make decisions for you, usually when you cannot do things for yourself. Common examples include when you are incapacitated or when you are travelling abroad.
Power of attorney documents continue until you revoke (cancel) the power or you lose the legal capacity to make particular decisions.
The basic power of attorney and the backup powers last until you cancel them or can’t make some decisions legally. If you have an ‘enduring’ power of attorney, it continues even when you are unable to make decisions on your own.
If you don’t designate someone and find yourself unable to make decisions when necessary, the Victorian Civil and Administrative Tribunal (VCAT) might step in, assigning entities like the Public Advocate or a trustee company to decide for you. Therefore, it is extremely important to have an enduring power of attorney so you can place the important decisions which affect you in people you want to and trust.
It’s crucial to pick someone you trust and whom you believe will act in your best interests. In a power of attorney setup, the individual granting the authority is termed the ‘principal’, while the one receiving the authority to act is known as the ‘attorney’. You have the option to appoint multiple people as attorneys.
Additionally, if there’s a situation where you can’t make health-related decisions due to injury or illness, you can designate someone to make those calls for you. This individual is termed a ‘medical treatment decision maker’.
