IMPORTANT INFORMATION

Before your notary public appointment with our Melbourne Notary Public, you need:

1. For witnessing a signature, the person whom the documents are about needs to be in our presence when signing the documents. If you are only wanting documents certified, the person whom the documents are about does not need to be in our presence. E.g. certifying true copies of passport pages can be done without the passport holder being at the appointment. 

2. To bring 100 points of ID it is generally advisable to bring your passport in addition to other forms of identification. We will use it to verify you and keep copies of the identification documents for our records.

3. To bring the original document/s, adequate copies and ensure its contents are correct before coming to the appointment. Please notify our office when calling if we need to verify original documents issued electronically. This keeps the appointment time to a minimum. DO NOT SIGN THE FORM UNTIL YOUR APPOINTMENT. 

4. To confirm with the recipient of your documentation whether a notarial certificate can be used to bundle multiple documents together and save you money or whether each document needs to be notarised separately. If you are unsure you can call our office on 03 9602 3988.

5. To confirm with the recipient of your documentation whether you need an apostille or authentication with DFAT.

Witness Signatures

Our notary public can witness signatures on ALL documents to be used in ANY overseas country. This involves notarising the execution of documents and agreements. For example, power of attorney, sales contract for overseas property/property documents, commercial and investments documents, bank account forms, travel authorisation for children, inheritance documents, probate parchments, taking acknowledgements of deeds etc). You should have forms pre-filled in (save for signing it).

Executing Power of Attorney

Our notary public can witness your signature when you sign your power of attorney for use overseas.

Certifying Documents

Our notary public can certify or attest to true copies of original documents. For example, identity documents (passports, birth/death/ marriage certificates), agreements, bank statements, visa documents, university documents such as university testamurs (degree certificate), letters of enrolment, awards, transcripts and diplomas etc).

Verifying Identity and Signatures

Our notary public can verify your identity for documents used overseas, including passports, driver's licence as well as utility bills.

Verifying Corporate Status

Our notary public can notarise Australian company documents including verifying company details, ASIC searches, company extracts, certificate of registration, certificate of company constitution, certificate of good standing and certificate of Legal Representative. We can also notarise company minutes, board resolutions, constitutions, shareholder agreements and certificates as well as Certificate of Good Standing.

If you are signing documents for and behalf of an Australian company, you need to bring your identification documents and authority documents showing you are authorised to execute documents for such entities.

Notarial Certificates

Notarial Certificates are an additional service to witness signatures because we bind and attach a notarial certificate to document/s.

We provide notarial certificates for Apostille or Authentication with the Department of Foreign Affairs. We can also do the legalisation of your document with the Embassy or Consulate.

Oaths, declarations and attestations

Our Notary Public can assist you with administering an oath or affirmation, taking a declaration and attesting a signature (including, where applicable, completing a jurat or pre-printed acknowledgement or the like). Please confirm if you need a notarial certificate when you call us.

A Notary Public is appointed by the Supreme Court of Victoria who is usually an experienced senior legal practitioner. A Public Notary are qualified to authenticate, witness and certify original and copy documents for use overseas. A Notary Public is given statutory powers to witness documents, administer oaths, and perform other legal functions of a national and international nature. Each Notary Public in Australia has held a principal practising certificate for 5 years and has undertaken further studies to become a Notary Public. Their position is very important as they are trusted for preventing fraud by declaring documents as true, witnessing signatures and verifying people’s identity.

A natural person or corporate entity that needs a document to be notarised for use in a jurisdiction outside Australia will need a notary public. What documents need to be notarised will depend on its purpose. Usually an overseas government department or lawyer will instruct you to get a document notarised by a Notary Public. Individuals, organisations and government authorities overseas want documents or signatures to be authentic and they can obtain this from a notary public. If you need to get a document certified for a matter strictly limited in Australia you you should engage a Justice of the Peace.

A notarised document is a document that a Notary Public signs when witnessing another person’s signature or when certifying that a document is a true copy of an original document. Common examples include power of attorney, qualifications and identity documents. The Melbourne Notary Public does not draft the documents that are to be used overseas.

A Notary Public can also prepare a notarial certificate, affix an official seal usually read or an inked stamp next to their signature and can bind the documents with a ribbon. Further steps in the legalisation process might need to be carried out for the document to be used overseas. Specifically, the notarised documents might need to be authenticated or apostilled by the Department of Foreign Affairs and Trade (DFAT) and/or embassies or consulates in Melbourne for further legalisation.

An Apostille is a certificate used for countries who are signatories to the Hague Apostille Convention where DFAT has verified the signature and seal of the Notary Public that notarised the document with the Apostille. Once DFAT has verified the Notary Public’s signature and seal on the notarised documents, they place an Apostille on the document which shows that the notarisation is authentic and is recognised by all signatory countries. Our Notary Public Melbourne can notarise private documents (such as contracts and power of attorneys) and copies of Australian Government-issued documents which DFAT can issue an Apostille.

An Authentication is used for documents intended for countries who are not signatories to the Hague Apostille Convention. If you require documents to be legally recognised in countries who are not signatories to the Hague Apostille Convention, then you may need to have your documents authenticated by DFAT as well as the consulate or embassy of the country you are intending to use the document in. You will need to be in the presence of our Public Notary in Melbourne for us to witness your signature on a document. 

You do not need to be in our office for us to authenticate a document or certify a document as a true copy of an original but you should still come to our Melbourne Office. 

Yes. In general, the notarisation requirements will depend on the Agreements between Australia and the other country.

  1. British dominions- countries that are in the British dominion include Canada, Australia, New Zealand, England, Scotland, Wales and Northern Island. Documents for these countries generally do not need further legalisation from DFAT or a consulate and can be notarised by a Notary Public. 
  2. Hague Convention Countries- documents for countries who are members of the Hague Convention usually require the document to be notarised by a Notary Public AND DFAT to provide an apostille certificate.   3.  Non-Hague Convention Countries- documents to be legalised in a non-Hague Convention Country, the document needs to be first notarised, then DFAT needs to legalise the document and then the document needs to be sent to the embassy or consulate for attestation.
