Foster Care Power Of Attorney For China
Update: Since 7 November 2023, China accepts apostilles under the Hague Apostille Convention. Most Australian documents for use in mainland China now need notarisation (where required) and a DFAT apostille only; the Chinese Consulate in Melbourne no longer legalises documents. See our China notarisation page. 自2023年11月7日起,文件经公证后由DFAT加签海牙认证即可在中国使用,无需领事认证。
Foster Care Power of Attorney for Children travelling to China
If you are sending your child to live with someone else in China, a foster care power of attorney (寄养儿童委托书) can be prepared and notarised in Melbourne. Whether you are an Australian citizen or Australian permanent resident, if your child was born in Australia and you still have family relatives in China, such as your parents, you can use a Foster Care Power of Attorney to authorise someone in China to take care of your child whilst they are living there. In this respect, many parents who are originally from China and now living in Australia want their child to experience life in China whilst they continue to work in Australia and/or there are difficulties of grandparents or relatives to apply for Australian visas. Please contact our office if you need to notarise a Foster Care Power of Attorney and we can advise the notarisation requirements including what documents to bring. Our Melbourne Public Notary will ensure the power of attorney is notarised and accepted by DFAT. We can also assist with lodging the notarised documents for an apostille from DFAT. Please speak to the relevant authorities in China as to their notarisation requirements for your particular situation to avoid delays.
